According to the following information from ESR news, “Employers are more and more aware of the importance of knowing if an applicant has a criminal record. Employers also have a legal duty to make reasonable inquiries about who they hire. They need to provide a safe workplace for all. If an employer hires a person with a criminal record, they can indeed be found liable for negligent hiring where the hiring decision results in harm. A simple criminal records check demonstrates Due Diligence, and is also an important preventative measure to protect against workplace violence”.
